NOTICE OF PUBLIC HEARING ON PROPOSED ASSESSMENT BEFORE THE BLAINE CITY COUNCIL ANOKA COUNTY, MINNESOTA 113TH AVENUE TRUNK SANITARY SEWER, IMPROVEMENT PROJECT NO. 17-09 NOTICE is hereby given that the City Council will meet at 7:30 PM, or as near that time as possible, on October 7, 2019, at the Blaine City Hall, 10801 Town Square Drive NE, in the Council Chambers, to pass upon the proposed assessment for the following improvements: Trunk Sanitary Sewer and related appurtenant construction in the following described area: The area south of 113th Avenue roughly bordered between Quincy Street on the west and Buchanan Street on the east as well as commercial property adjacent to 109th Avenue between Able Street and Filmore Street. The lands to be assessed are the property within the above described area. The proposed assessment roll is on file with the City Clerk and is available for public inspection at my office. Written or oral objections by any property owner will be considered at the hearing. No appeal may be taken as to the amount of any assessment adopted at the assessment hearing, unless a written objection, signed by the affected property owner, is filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The total cost of this improvement is three hundred ninety-one thousand five hundred fifty-eight and 65/100 ($391,961.65) and the amount to be specially assessed is hereby declared to be three hundred fifty-nine thousand nine hundred sixty-one and 65/100 ($359,961.65). An owner may appeal an assessment to District Court pursuant to Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or Clerk of the municipality within thirty (30) days after the adoption of the assessment and filing such notice with the District Court within ten (10) days after service upon the Mayor or Clerk. An owner is advised that a Hardship Special Assessment Deferral, pursuant to Minnesota Statutes Sections 435.193 to 435.195, is available for certain senior citizens, persons retired by a permanent and total disability or persons who are ordered into Active Military Duty. The City of Blaine has adopted a resolution establishing a deferment procedure and guidelines for determining the existence of the hardship. An owner shall make application not later than at the assessment hearing for deferred payment of a special assessment on forms prescribed by the City Clerk of Blaine.
